Towards Cultural Digital: tools, limits and opportunities in the Italian legal framework

Digital technology has brought a paradigm shift in the conformation of the cultural asset and has opened up new possibilities for enjoying culture. Also the national recovery and resilience plan has considered the potential of this approach, identifying the creation of a cultural digital heritage as one of the priority objectives of future national policies. Nevertheless, this objective seems to be too ambitious considering the available tools: on the one hand the Code of cultural heritage still remains firmly anchored to a material concept of cultural asset and to the proprietary regime of cultural heritage; on the other hand, the access to internet networks, which is instrumental for the effective enjoyment of certain fundamental rights and freedoms, does not seem to be ensured with a sufficient guarantee of uniformity. In this framework, the report aims at identify the challenges, the opportunities and the limits of digital culture as a tool for reducing social inequalities.
