Neuro-rights and Manipulative Techniques: Between New Rights and Old Needs

The cultural emergence of neuro-rights is driven by the development of technology, neuroscience, and artificial intelligence, which offer new potentials but also power tools capable of undermining the standard matrix of neuronal rights: cognitive freedom (Ienca). According to Rodotà technologies challenge old rights and urgently demand new ones, propelling us into a debate on the emergence of new rights or dimensions originally not contemplated for the protection of dignity and traditional freedoms (Modugno; D'Aloia). This issue interrogates the constitutional aspects of fundamentality and the balancing of rules.
