Abstract

The Italian legal system consists of rules and principles of national and supranational sources to which the ABF is subjected as a result of the principle of legality. Therefore, the guidelines of the Financial Banking Referee have also developed through fruitful dialogue with the European and national Courts. In this sense, the dialogue with the Court of Justice regarding the full comprehensibility and clarity of the contractual terms and the reduction of the cost of the credit in the case of early repayment is particularly relevant. The dialogue with the Supreme Court concerning usury is also intense.
