The presentation gives an example of how the EEC past can be prologue for the future of European constitutionalism by discussing some aspects of the application of the principle of sincere cooperation by the Court of Justice of the European Union. The presentation shows how the ECJ has come to apply this principle in conjunction with the principle of effective judicial protection to ensure respect for one of the founding values of the EU, namely the rule of law. The presentation also shows how this case-law has a limit since it cannot be transposed to every case of systemic violation of EU values.
