The paper analyses the genealogy of the Italian legal framework on immigration in the Kingdom of Italy after the unification in the XIX Century and in the fascist era. Then, the building and the rationale of the Italian migration law are analysed starting from the general principles in the Italian Constitution. Finally, the rationale of the Italian migration law is compared with the proposals of reform in the 2015 EU Agenda on migration and the present trends of EU migration law.
