The research starts from focusing on the introduction of the Napoleonic legal system in the Kingdom of Naples in the beginning of the XIX century, as a “prototype” of the rising legal framework to control and limit the freedom of movement of foreigners. In the new Kingdom of Italy we can find the persistency and the continuity of this legal framework. The main characters of the emigration and immigration law of the Kingdom of Italy are analysed as “physiological” powers of the PA. This perspective allows to analyse the EU new legal framework on immigration in a perspective of participatory democracy.
