The essay examines the migratory “crisis” before Italian and European supranational courts, focusing on the judicial protection of migrants’ fundamental rights. It analyses how constitutional, ordinary, EU and Strasbourg courts have addressed tensions between border control, State sovereignty, security, asylum, non-refoulement, procedural guarantees and human dignity. The contribution shows that courts have played a crucial role in shaping a multilevel space of protection, limiting State discretion where migration policies affect vulnerable persons and core constitutional and European rights.
