The focus is the application of art. 844 code civil and the new constitutionally oriented interpretation of it. Now art. 844 requires the judge to consider the protection of the quality of life and health as prevailing, in balancing the needs of production with the reasons of property, regardless of the priority of a particular use and even if in concrete terms, the limit of normal tolerability has not been exceeded.
