Ancora in tema di audizione del minore: riflessioni a margine della pronuncia n. 14/2021 della Corte costituzionale.

This work analyzes the ruling n. 14 of 2021, with which the Constitutional Court declares unfounded the question of constitutionality raised in relation to the “special” probative incident. In particular, the equation between the minor offended person and the minor witness was deemed justified and not manifestly unreasonable, to proceed with the forms of early acquisition. The sentence represents the umpteenth expression of a progressive twilight trend in the trial phase, with consequent involution of the evidence acquisition site to the preliminary investigation phase.
