This work analyzes the judgement with which the Court of Cassation extended the art. 578-bis c.p.p. to urban confiscation. By doing so, it established that, in the event of a declaration of extinction due to the prescription of the crime, the judges of impugnment are required to decide on the proportionality of the confiscation, in accordance with the provisions of the European Court of Human Rights.
