LA QUESTIONE INDIPENDENTISTA CATALANA TRA AUTODETERMINAZIONE, SECESSIONE E NUOVI ACCORDI CON IL GOVERNO SÁNCHEZ

Secessionism is a phenomenon which has affected various legal systems, such as the Catlunian one, spreading the debate around the possibility for a region to secede from the State in order to proclaim its independence therefore to assert its international legal personality. The uncertainty about the exact legal status of secessionism leads us to investigate more deeply the so-called “Catalan question”. Six years after the referendum on Catalan independence, on 1st October 2017, the debate on the “Catalan question” is rekindled as a result of the investiture of Pedro Sánchez as Prime Minister. He was forced to make agreements with the Catalan independence parties in order to achieve their support on making up the government. It could be the proper occasion to direct Catalonian claims, transforming unilateral and independentist claims into legitimate autonomist aspirations.
