The essay explains the vicissitudes of arbitration in the Public Contracts Codes, in particular the continuities and discontinuities between the old and new legislation. The latter’s reference to common law arbitration makes it necessary to examine the reflections of the contemporaneous reform of the Code of Civil Procedure on the discipline of the special arbitration. The synthesis that realizes the discipline of such arbitration is set out here.
