The paper illustrates and discusses the Judgment handed down on 6 April 2023 by the International Court of Justice in the case concerning the Arbitral Award of 3 October 1899 (Guyana v. Venezuela). It critically reviews the approach taken by the Court towards Venezuela’s preliminary objection based on the Monetary Gold principle. The paper submits that the Court did not adequately take into consideration all interests potentially affected by a decision rendered in the absence of an indispensable third party, including the interests of the actual parties to the case and the interest to the safeguard of the Court’s judicial function.
