Article 1696 of the Italian Civil Code has been amended by the law decree nr 152 of the 6th November 2021 regarding the implementation of the National Recovery and Resilience Plan (NRRP). The amendments are in part irrelevant and they do not resolve long-standing problems arising from such rule which might then request a ruling by the Italian Constitutional Court. Without prejudice for that, it is positive that other amendments introduce for the first time an Italian discipline applicable to multimodal transport and make mandatory in favor of the cargo interested party the regime for calculating the value of the cargo provided for by Article 1696 of the Italian Civil Code. Furthermore, it is also very positive that in implementing the National Recovery and Resilience Plan the legislator has regulated the matter of the liability of the carrier, thus placing at the center of the debate one of the most important issues of transport law. We hope that this approach will be continued in the near future, as it is no longer possible to ignore that transport and logistics are really the keystone for a "sustainable development".

Abstract
