Even if in public tenders and competitions the excluding clauses are not all the same (only some of them, in fact, make it impossible to process and submit an application to participate) the treatment reserved for them by administrative jurisprudence is substantially uniform. In this perspective, perhaps the administrative judge exceeded the moment in wich he began to believe that always, in presence of any type of exclusion clauses, the competition notice can be contested without having to first submit one’s application for participation.
