Il "terzo pilastro" dell'Unione europea tra buona fede e leale collaborazione

The Third Pillar of the European Union between Good Faith and Sincere Cooperation This article is focused on the general principle of sincere cooperation (or principle of loyalty) stems from Article 10 of the Treaty establishing the European Community. The paper aims to ascertain what is the role of this principle in the Third Pillar, moving from its international character. In particular, this analysis aims to evaluate the effectiveness to use this principle in the field of police and judicial cooperation in criminal matters, and to verify the consequences, in order to clarify the real meaning and the value of the principle of loyalty in the Third Pillar, and, to outline for the future the role that it will have if the Lisbon Treaty will come into force.
