This paper focuses on the exceptions or limitations to the Copyright Package Directive, in order to allow cultural heritage institutions to make available out-ofcommerce works, and doubts such exceptions still comply with a proprietary system. Furthermore, it aims at demonstrating that they seem to conflict with some of the author’s moral rights, such as the right to withdraw.
