L'attività di avvocato e il contestuale svolgimento di un rapporto part time nel pubblico impiego: una contesa conclusa?

The article analyzes the legislative changes and the orientations of the Courts on the theme of legitimity of profession of lawyer and of the part-time job in the public sector. The discussion starts from the l. n. 662/1996, which permits the right of civil servants to transform the relationship from full time to part time, in the case the civil servant prefers to accomplish a second work. In addition, are taken in exam the conditions of exercise of this right for lawyers, considering that the l. n. 339/2003, has provided for them a rigid system of incompatibilities, that has indirectly caused the inapplicability of the l. n. 662/1996. The article evaluates the compatibility of the right to part-time job for civil servants in the case to execution, as second activity, of the profession of lawyer, examining the position of the Constitutional Court and the changes introduced with l. n. 247/2012.
