The nature of the transformations induced by the so-called “Digital disruption” affects all segments of financial intermediation and is such as to affect the ability of current “law” and related enforcement mechanisms to deal with new risks (not necessarily related only to the economic sphere) and new cases or, on the other hand, not to hinder innovation. In front of breakdown of the production process of this magnitude, therefore, a fundamental rethinking of the perimeter and the qualifying characteristics of the markets and their rules is required, starting from a refocusing of the interests worthy of being protected, which takes due consideration the disurptive and at the same time global dimension of Fintech platforms.
