The article aims to analyze the Outermost Regions (ORs) legal status, notoriously marked by a constant balance between the ideal full application of the EU Treaties and the need to take into account the geographical characteristics and the peculiar factors of these regions. After an overview on the evolution of legal sources, the study focuses more closely on some issues concerning the content and the scope of Article 349 TFEU, as it has been interpreted by the ECJ in its 2015 judgment. Moreover, attention is paid to the leading role of the EU Council in the decision making process regarding the ORs. As final remarks, the paper examines the procedure contained in Article 355 (6) TFEU concerning a possibility of simplified status change.
