L'amministrazione comunitaria nel settore delle biotecnologie

The aim of this paper is to analyze the EU biotechnology regulations related, in particular, with the administrative organization. The analysis is especially focused on the Directive 2001/18/CE, even though, during the investigation, other provisions are gradually taken into consideration. The conclusion is that in the biotechnology sector the EU administration complies with the organizational models typical of the States, by means of a decision making power atypical if referred to the coordination role traditionally assigned to the Commission. On the other side, the risk is that this major power induces a substancial decrease of the decision making role of the EU, because, according to available data, member States, by means of the so called «comitology», are the actual holders of the power to decide.
