Tecnologie ICT: un utilizzo trasparente per la salute e sicurezza dei lavoratori anziani

This paper examines the legal and regulatory dimensions of employing Information and Communication Technologies (ICT) and intelligent digital systems in safeguarding the health and safety of older workers. Taking a multi-level approach, the analysis surveys both Italian and European law— including Legislative Decree No. 81/2008, the “Decreto Anziani”, the AI Act, Directive (EU) 2024/2831, and Regulation (EU) 2023/1230— to assess whether current frameworks adequately balance risk prevention and health promotion. Particular attention is devoted to risk assessment, occupational health surveillance, the role of the competent physician, and the participative function of the Workers’ Safety Representative. The paper argues that transparency—in decision-making, design, deployment, and monitoring of ICT systems—is essential to ensure these technologies serve rather than compromise safety, especially for workers of advanced age.
