This paper analyzes the issue of standing in climate change litigation, from both an active and passive perspective. Starting from the assumption that the issue should be investigated only on the basis of the procedural rules specific to each legal system (while comparison can only be useful from a de iure condendo perspective), the conclusion is that, in Italy, standing can only be recognized in a few limited cases. However, this does not exclude the likelihood that this type of litigation, being strategic, will still achieve its objectives.

Abstract
This paper analyzes the issue of standing in climate change litigation, from both an active and passive perspective. Starting from the assumption that the issue should be investigated only on the basis of the procedural rules specific to each legal system (while comparison can only be useful from a de iure condendo perspective), the conclusion is that, in Italy, standing can only be recognized in a few limited cases. However, this does not exclude the likelihood that this type of litigation, being strategic, will still achieve its objectives.| File | Dimensione | Formato | |
