This essay explores material interferences between legislative compe- tences as a lens through which to read the evolving nature of italian region- alism, increasingly shaped by a case-driven and centripetal constitutional jurisprudence. by distinguishing the different forms of hybridisation – both vertical and horizontal – the analysis shows how the very lexicon of «mat- ters» has become the site of an interpretive ambiguity that enables the con- stitutional court to translate multiple overlaps into state prevalence, turning cooperation into an occasional practice rather than a structural principle. transversality, the «point of equilibrium» doctrine, and the selective use of prevalence reveal a dual-guarantee model of regionalism in which suprem- acy often hides behind the ambiguous vocabulary of cooperation. the essay therefore argues for the potential of a form of «cooperative prevalence» and of a «well-tempered» guarantee-based regionalism, in which disentangle- ment does not reproduce centralising automatisms but instead works as a form of «nudge supremacy, encouraging more stable and genuinely repre- sentative channels of inter-institutional dialogue.

Abstract
This essay explores material interferences between legislative compe- tences as a lens through which to read the evolving nature of italian region- alism, increasingly shaped by a case-driven and centripetal constitutional jurisprudence. by distinguishing the different forms of hybridisation – both vertical and horizontal – the analysis shows how the very lexicon of «mat- ters» has become the site of an interpretive ambiguity that enables the con- stitutional court to translate multiple overlaps into state prevalence, turning cooperation into an occasional practice rather than a structural principle. transversality, the «point of equilibrium» doctrine, and the selective use of prevalence reveal a dual-guarantee model of regionalism in which suprem- acy often hides behind the ambiguous vocabulary of cooperation. the essay therefore argues for the potential of a form of «cooperative prevalence» and of a «well-tempered» guarantee-based regionalism, in which disentangle- ment does not reproduce centralising automatisms but instead works as a form of «nudge supremacy, encouraging more stable and genuinely repre- sentative channels of inter-institutional dialogue.| File | Dimensione | Formato | |
