La delega alla macchina delle attività processuali binarie

L’impiego dell’intelligenza artificiale nelle attività giudiziarie ormai è disciplinato sia a livello comunitario che nazionale, con il riconoscimento delle sue ammissibilità e utilità in termini di efficienza processuale, ma soprattutto con l’individuazione dei suoi rischi e conseguenti limiti; in questo quadro l’Autore prova a identificare un’ampia fascia di attività processuali delegabili in diversa misura alla macchina, per garantire una più probabile effettività della tutela giurisdizionale, senza correre questi rischi e senza superare questi limiti. The use of artificial intelligence in judicial activities is now regulated at both the EU and national levels, with the recognition of its admissibility and usefulness in terms of procedural efficiency, but above all with the identification of its risks and consequent limitations. Within this framework, the author attempts to identify a broad range of procedural activities that can be delegated to machines to varying degrees, to ensure a more likely effectiveness of judicial protection, without running these risks and without exceeding these limits.
