Un anno di “tono costituzionale”: alcune riflessioni sulla giurisprudenza costituzionale successiva alla sentenza n. 181 del 2024 in tema di rapporti tra ordinament

This paper examines the recent jurisprudential shift in the relationship between the Italian and European Union legal systems following Italian Constitutional Court judgment no. 181/2024. By analyzing the 2025 case law applying the new “constitutional dimension” doctrine, and against the backdrop of the Court of Justice's case law on primacy, the Author criticizes the potential marginalization of common judges and the risks to the uniform application of EU law. Finally, he advocates for a return to the foundational principles of Article 11 of the Italian Constitution to ensure loyal cooperation within the European integration process.
