La pericolosità sociale minorile tra sicurezza, prevenzione e (ri)educazione

The concept of juvenile social dangerousness has been shaped by theoretical compromises and regulatory interventions that have progressively redefined its meaning and implications. This paper aims to trace its evolution and analyze the current and complex framework of security, preventive, and re-educational measures targeting young people. The legislator’s approach—heavily focused on a (para)penal reaction at the expense of robust social policies—appears inadequate to safeguard the right to education and ultimately undermines the very notion of (non) imputability.
