L’arrêt Real Madrid et d’autres avancées pour protéger la liberté de la presse et la démocratie européenne

On the basis of the findings of the Real Madrid judgment of the Court of Justice of the European Union (Case C-633/22), this article briefly reflects, on the one hand, on some key aspects of the regime of recognition and enforcement of judgments in the European Union, such as the competence of the court of the addressed State and the public policy (ordre public) in its “substantive” dimension, and, on the other hand, on the role that the European Union institutions are playing with regard to the protection of the freedom of the press. The final aim of the research is to assess the extent to which the judgments and acts adopted contribute to improving the protection of democracy, a fundamental value of the European Union that is currently in crisis. _ A partire dalle statuizioni della sentenza Real Madrid della Corte di giustizia dell’Unione europea (causa C-633/22), nel presente articolo si riflette brevemente, da un lato, su alcuni aspetti chiave del regime di riconoscimento ed esecuzione delle decisioni nell’Unione europea, quali la competenza del giudice dello Stato richiesto e l’ordine pubblico nella sua dimensione “sostanziale”, e, dall’altro, sul ruolo che le istituzioni dell’Unione europea stanno giocando sul fronte della tutela della libertà di stampa. L’obiettivo finale della ricerca è quello di valutare in che misura le sentenze e gli atti adottati contribuiscono a migliorare la tutela della democrazia, un valore fondamentale dell’Unione europea attualmente in crisi.
