The paper offers a brief updated synthesis of the European Union (EU) regulatory activity in the nanofood field and analyzes the causes of the still inadequate legislative framework. The goal of the paper is to point out the main factors that prevent the EU from implementing an effective regulatory policy, in order to help the policy maker to batter tackle the incertitude and the ethical dilemmas characterizing the issue of nanofood regulation. The conclusion is that the current poor nanofood regulation depends both on risk assessment difficulties and on the neoliberal attitude of the EU. In particular, the paper shows that the endorsement of a stakeholder approach in decisional processes has fostered the lobbying of agribusiness companies more than an improvement to democratic participation in legislative processes. Without the acknowledgement and the removal of the current political creed, it is very unlikely that regulatory programs will move towards the achievement of well-being of society at large.
