The right to strike in nine European countries (Bulgaria, France, Germany, Great Britain, Italy, Poland, Romania, Spain, and Sweden) even in the light of the issues raised by the EU Court of Justice decisions. The study has been devoted to both the national case law (departing from constitutional law) and the Community case law and the relationship between national and supranational jurisdictions, in order to examine the problematic issue of the guarantee of trade union rights in the European zone and scrutinize the circumstances in which the strike – in most member countries classed as a right – can come into conflict with the freedoms of establishment and movement.
